(a) Abandonment is presumed seven years after the expiration of the initial time period or any renewal time period.
(b) 1. A gift certificate or gift card that is not assessed any fees and does not have an expiration date is not presumed to be abandoned
2. Any gift certificate or gift card that contains an expiration date or requires any type of post-sale finance charge or fee must contain a statement clearly and conspicuously printed on it stating whether there is a fee, the amount of the fee, how often the fee will occur, that the fee is triggered by inactivity of the gift certificate or gift card, and when the fee will be assessed. A gift certificate or gift card subject to an expiration date must contain a statement clearly and conspicuously printed on the gift certificate or gift card stating the expiration date. Gift certificates or gift cards in this category are presumed abandoned three years from the date of issuance.
3. General-use prepaid cards (a plastic card or other electronic device usable with multiple, unaffiliated sellers of goods or services) are specifically excluded from the three year abandonment provisions. Therefore, general-use prepaid cards are subject to a presumption of abandonment if the unredeemed value of the card, after deducting any lawful charges, has remained unclaimed by the owner for more than five years after the occurrence of the last transaction.
(c) Any person holding intangible property presumed abandoned due to be reported with a cumulative value of fifty dollars or less in a single reporting year shall not be required to report the property in that year but shall report the property in any year when the property value or total report value exceeds fifty dollars.
