The Nebraska Uniform Disposition of Unclaimed Property Act, found at Neb.Rev.Stat. § 69-1301 et seq., provides for dormant accounts and other unclaimed property reports, presumption of abandonment dates and procedures.
Holders of unclaimed property can access the website of the Nebraska State Treasurer at https://treasurer.nebraska.gov/ to create an Unclaimed Property Holder Reporting Account for the submission of an unclaimed property report or file.
Among the several questions fielded by the NBA Office regarding dormant accounts is whether it is allowable to charge the monthly service charge, in addition to a dormant account fee, on a dormant account. Regulation DD requires the financial institution to disclose all charges but does not regulate what the institution charges or the purpose of the charge. Nebraska state law, while not regulating the amount of fees to be charged or the purpose of the charge, does provide that the charges must be provided for by written contract. Therefore, in Nebraska, once an account has become dormant, the bank may continue to service charge the account so long as agreed to by written contract.
